In April 2020, the remains of 50-year-old David Michael Fouts were found near Noblesville, Indiana, in a roadside ditch. As officials began investigating the circumstances surrounding his death, the case took a heartbreaking turn, revealing that someone close to him had played a role in his death. David Fouts’ Remains Were Found in a Roadside Ditch in Indiana
David Michael Fouts was born sometime around 1969 or 1970. Few public reports provide information about his early life. However, we do know that he was well-liked by his friends and family. After completing his formal education, he entered the workforce. Eventually, he became a Senior Consultant and Technology Architect at Salesforce, which is a cloud-based software company. Besides that, David was an avid cyclist who often took part in charity cycling events. In adulthood, he entered a relationship that led to his first marriage. Unfortunately, that union did not work out and ended in a divorce.
David thought he had got a second chance at love when he crossed paths with Katrina Louise Fouts. She already had a daughter, Carrie Lee Gentry, from a previous marriage. After dating for 3 years, Katrina and David finally tied the knot in 2019. Everything was going well until his life turned upside down on April 24, 2020. On that fateful day, a woman was walking her dog along Overdorf Road in Noblesville when she spotted the decomposing remains of a man in a ditch and promptly called 911. When officials arrived, they found that he was barefoot, but his feet were clean, leading them to believe that he was likely killed somewhere else.
Forensic experts noted that he had a bloody shirt wrapped around his wrist, and there was evidence suggesting the presence of duct tape residue around his wrists and ankles. Ultimately, the remains were identified as David’s through his fingerprint records. The autopsy report revealed that he had no major injuries, and no toxins were found in his body. Further examinations revealed that his stomach contents included pieces of the toxic Lyophyllum connatum mushrooms. Its toxin reportedly becomes undetectable within 72 hours. They were unable to determine if that toxin caused David’s death. His manner of death was ruled a homicide.
Cellphone Records and DNA Evidence Helped in Identifying the Prime Suspects
During the initial investigation, officials discovered that David was last seen alive on April 21, 2020. When detectives questioned Katrina, she claimed she last saw him on April 21, adding that she and her husband were living separately in two homes. In her statements, she alleged that David had been having an affair for several months. Police records indicate that in September 2019, he was arrested and charged with invasion of privacy and domestic battery based on allegations made by Katrina. A judge issued a no-contact order between them, and David pleaded not guilty, intending to contest the charges at an upcoming court date.
It is essential to note that David was never convicted or sentenced for the charges. Authorities then searched Katrina’s phone, which revealed a screenshot of the death cap mushroom, a poisonous species, according to reports. Further court records suggest that she had searched terms like “crimes of passion Indiana” and “What it takes to get an arrest warrant for murder in Indiana” on the internet. Digital forensic experts learned from her phone records that she frequently spoke on calls with a man named Terry Hopkins. He was Katrina’s father’s caretaker, and when she was questioned, she claimed he was a family friend, per the records. Detectives discovered that Terry and Katrina’s phones were inactive early on the night of April 22.
The phones reportedly became active again around 11 am on April 22. Further records indicate that when Katrina and Terry’s vehicles were searched, walkie-talkies were found inside, all set to the same channels. At Terry’s home, officials recovered recently bought items, including duct tape, zip ties, rubber gloves, and rope. The receipts and CCTV footage presented in court revealed that he had purchased them. Investigative reports state that a rubber mat found on a lift cart at Katrina’s home tested positive for David’s DNA. Moreover, the blood on the shirt recovered from his remains matched Terry, as per court records. On September 17, 2020, Katrina and Terry were arrested and charged with murder, conspiracy to commit murder, and failure to report a corpse. She also faced an additional charge of false informing.
Katrina Fouts is Incarcerated at an Indiana Prison Facility Today
Following Katrina and Terry’s arrest, they were scheduled to undergo a jury trial. However, on February 3, 2022, just two months before his trial, Terry passed away from his declining health. Following that, the charges against him were formally dismissed. Shortly after, the false informing charge against Katrina was also dismissed. Her jury trial commenced in March 2022, during which the prosecution alleged that she conspired with Terry to kill David by giving him poisonous mushrooms. They also highlighted her web searches, forensic evidence, and cellphone records.
On the other hand, the defense argued that there was no evidence that Katrina had committed the murder or was involved in the crime. Ultimately, she was found not guilty of murder, but she was convicted of conspiracy to commit murder and failing to report human remains. On April 20, 2022, she received an aggregate 34-year term in prison for conspiracy to commit murder, with credit for time already served. She also received 772 days of good-time credit. Moreover, Katrina received an additional 1-year sentence for the second charge, with 183 days of credit, to be served concurrently.
Katrina later appealed her judgment, challenging the sufficiency of the evidence and alleging prosecutorial misconduct. However, on April 24, 2023, the Appellate Court affirmed her convictions and sentencing. Shortly after, she filed a petition for rehearing, but on June 13, 2023, the court granted a rehearing only to correct an error regarding the location of the life cart. The court noted that officials erred in stating that the lift cart was found in Katrina’s home because it was actually located at Terry’s residence. However, they notably reaffirmed her sentence. Katrina is currently serving her sentence at the Indiana Women’s Prison in Indianapolis, Indiana. Her earliest possible release date is set for March 19, 2046.
